These Terms & Conditions (“Terms”) govern your access to and use of the website and services of A.RSM Truck & Forklift Driving School Inc. operating as ARSM Training Centre (“ARSM”, “we”, “us”, or “our”). By using our website, creating an account, applying for a course, purchasing a safety product, or paying online, you agree to these Terms.
1. Who we are
ARSM provides forklift and powered industrial truck theory training, related certification programs, practical evaluation (where arranged), and safety product sales. Our principal place of business is 60 Nugget Ave, Unit #13, Scarborough, Ontario M1S 3A8, Canada. HST #: 838471241RC0001.
2. Eligibility and accounts
- You must provide accurate registration details (name, email, and phone where requested).
- You are responsible for keeping your login credentials confidential and for activity under your account.
- We may suspend or terminate accounts that misuse the site, share protected course content, or engage in fraud.
3. Courses, applications, and access
- Adding a course to your cart and paying does not guarantee immediate lesson access.
- After successful payment, a course application may be created and remain subject to admin approval.
- Lesson content is licensed for personal training use by the enrolled student only. Copying, downloading, redistributing, or publicly sharing protected materials is prohibited.
- Practical training, assessment dates, and on-site evaluation (if required for your program) are scheduled separately and may depend on instructor availability and your readiness.
- Certificates are issued when course completion requirements are met under our program rules.
4. Safety products
Product descriptions and images are provided to help you choose. Colours, packaging, or stock availability may vary. If an item cannot be fulfilled after payment, we will contact you to arrange a suitable replacement, store credit, or refund according to section 7.
5. Pricing, taxes, and invoices
- Prices are shown in Canadian dollars (CAD) unless stated otherwise.
- Applicable HST (13%) may be added at checkout and shown on your invoice.
- After successful payment, an electronic invoice/PDF may be generated for your records.
- We may correct obvious pricing errors before or after acceptance; if we cancel an order due to error, you will receive a refund of amounts paid for that order.
6. Payments via PayPal
We accept online payment through PayPal. By selecting PayPal at checkout you agree that:
- Payment is collected by PayPal on our behalf according to PayPal’s buyer terms and your PayPal account settings.
- An order is confirmed only after PayPal reports a successful capture/authorization to ARSM.
- If payment is cancelled, declined, reversed, or fails, we may cancel the order and withhold course access or product fulfillment.
- You authorize us to use PayPal transaction references (such as PayPal order/capture IDs and payer email) for order confirmation, invoicing, fraud prevention, and customer support.
- Currency conversion, funding source fees, or PayPal account limits are between you and PayPal.
- PayPal may offer buyer protection for eligible purchases under its own rules; that protection is separate from any remedy we provide under these Terms.

7. Refunds and cancellations
- Courses: Refund requests must be submitted in writing (email) before substantial access to paid lesson content, or within 7 days of payment if access has not been approved/used — whichever applies. After lessons have been substantially accessed, or a certificate has been issued, fees are generally non-refundable except where required by law or where we cancel the program.
- Safety products: Unused products in original condition may be eligible for return within 14 days of delivery/pickup if we confirm the return in advance. Shipping costs (if any) may be non-refundable.
- Approved refunds are normally returned to the original PayPal payment method. Processing time depends on PayPal and your financial institution.
- Chargebacks filed without first contacting us may delay resolution; please email us first so we can help.
8. Intellectual property
Website design, logos, course text, media, and training materials are owned by ARSM or its licensors. You receive a limited, non-transferable licence to view materials for personal training while enrolled. No other licence is granted.
9. Acceptable use
You agree not to:
- Attempt to bypass content protection, scrape, or harvest course materials;
- Use the site for unlawful, abusive, or fraudulent activity;
- Interfere with site security or other users’ access;
- Misrepresent your identity or qualification status to employers or third parties.
10. Disclaimer of warranties
Services and materials are provided on an “as available” basis. Except as required by law, we disclaim warranties of uninterrupted access or fitness for a particular workplace. See also our Disclaimer.
11. Limitation of liability
To the maximum extent permitted by law, ARSM’s total liability for any claim relating to a purchase is limited to the amount you paid to ARSM for that specific course or product. We are not liable for indirect or consequential loss, including lost wages or business interruption, except where such limitation is prohibited by law.
12. Privacy
We collect account, application, order, and payment-status information needed to deliver training and fulfill orders. Payment card data is handled by PayPal. Contact us if you need to update your profile information.
13. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the site after updates constitutes acceptance of the revised Terms for future purchases and use.
14. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Courts in Ontario shall have exclusive jurisdiction, subject to any rights you may have under applicable consumer legislation.
